Right to restrict processing

Le **drThe right to restriction provided for in Article 18 of the GDPR allows data subjects to request that their data processing be restricted. This right is often exercised as an alternative to requesting the deletion of data.

It may be exercised:

  • when the accuracy of the personal data is disputed, for a period allowing the controller to verify their accuracy when the processing is unlawful and the data subject objects to their erasure and requests their restriction.
  • when the controller no longer needs the data for the purposes of processing, but they are still necessary for the data subject to exercise legal rights
  • where the processing is unlawful and the data subject objects to its erasure and requests its restriction
  • where the data subject has objected to the processing during the verification as to whether the legitimate grounds pursued by the controller override those of the data subject.
