A ‘downstream provider’ means a provider of an AI system, including general-purpose AI systems, which integrates an AI model (Article 3(68) of the AI Act).

A provider of an AI system is still considered to be a downstream provider, regardless of whether the AI model is:

  • provided by themselves and vertically integrated,
  • or provided by another entity based on contractual relations.
