Claims and litigation management
Claims management refers to situations where the policyholder contests a decision or lack of response from the insurance organization. This involves processing operations that take place in the context of litigation relating to the insurance contract, and which enable the company to establish, exercise or defend its legal rights or the rights of the persons concerned, or to process claims in accordance with mediation procedures. The legal basis for data processing relating to litigation concerning the application of contracts is the performance of the insurance contract.

Data conservation rules

Active base:

Data necessary for the performance of a contract is kept for the duration of the contractual relationship. It may also be kept: - for a period of 3 years from the last contact that the persons to whom it relates have had with the organization (e.g., in the case of customers, a purchase or an order), after the contract has been fulfilled, for intermediate archiving, if the data controller has a legal obligation to do so (for example, to meet accounting or tax obligations) or if it wishes to establish proof in the event of litigation, and within the limit of the applicable statute of limitations
